Terms of Service
Effective date: May 7, 2026
These Terms of Service (“Terms”) form a binding agreement between you and NAMPS (“NAMPS,” “we,” “us,” “our”) governing your access to and use of the NAMPS matrimonial registration platform and related websites, applications, and services (collectively, the “Service”).
NAMPS is operated by volunteers from the North American Malayali Pentecostal community for the benefit of attendees of PCNAC 2026 and the broader community.
Please read these Terms carefully. By accessing or using the Service, you agree to be bound by them. If you do not agree, please do not use the Service.
1. Acceptance of Terms
By creating an account, registering a profile, or otherwise accessing the Service, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you are using the Service on behalf of another person (a son, daughter, sibling, or relative/friend), you represent that you have their explicit authorization to do so and that they have agreed to these Terms.
2. Eligibility
To use the Service, you must:
- Be at least eighteen (18) years of age. The Service is not available to minors.
- Be currently seeking marriage with serious intent. The Service is not designed for casual dating, friendship, or entertainment.
- Be a member of, or affiliated with, the Pentecostal community served by NAMPS — or be registering on behalf of such a person with their explicit and informed consent.
- Not be a person barred from receiving services under the laws of the United States or the jurisdiction in which you reside.
- Have the legal capacity to enter into a binding contract.
We reserve the right to refuse Service or terminate accounts at our discretion, including where eligibility cannot be confirmed.
3. Account registration
To use most features, you must register an account by providing a valid email address (which we verify with a one-time code), a phone number, and the profile information described in the registration form. You agree to:
- Provide accurate, current, and complete information.
- Keep your account information updated.
- Maintain only one account per individual. Duplicate accounts and impersonation accounts are prohibited.
- Keep your account credentials confidential and not share them with anyone.
- Notify us promptly if you suspect unauthorized access to your account.
You are responsible for all activity that occurs under your account.
4. License to use the Service
Subject to your compliance with these Terms, NAMPS grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use of seeking a marriage partner.
You may not:
- Reproduce, modify, distribute, sell, or sublicense the Service or any part of it.
- Reverse-engineer, decompile, or attempt to extract the source code of the Service except where this restriction is prohibited by applicable law.
- Use any robot, spider, scraper, or other automated means to access the Service or to harvest information about other members.
- Use the Service in any way that could damage, disable, overburden, or impair it.
5. Acceptable use
You agree not to:
- Create fake or fraudulent profiles, use someone else’s photos or likeness, or otherwise misrepresent yourself, your family member, or anyone else.
- Harass, intimidate, threaten, defame, or send unwanted explicit content to other members.
- Post or transmit content that is unlawful, obscene, defamatory, hateful, or that violates the rights of any third party.
- Use the Service for any commercial purpose, including solicitation, advertising, recruiting, or fundraising unrelated to NAMPS.
- Scrape, copy, screenshot-and-redistribute, or otherwise harvest profile data, photos, or contact information from other members.
- Attempt to circumvent the photo-review process or the mutual-consent contact-exchange controls.
- Bypass, disable, or otherwise interfere with security features of the Service.
- Encourage or assist any third party in doing any of the above.
- Violate any applicable law in connection with your use of the Service.
Violations may result in suspension or termination of your account, and may be reported to law-enforcement authorities where appropriate.
6. User content
6.1 Ownership.You retain ownership of the content you submit to the Service, including your photos, profile description, marriage preferences, and any messages you send through the Service (collectively, “User Content”).
6.2 License to NAMPS. By submitting User Content, you grant NAMPS a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, modify (e.g., resize photos), and distribute your User Content solely for the purpose of operating, providing, and improving the Service. This license terminates when you delete the User Content or your account, except for: (a) backups retained for a reasonable period as a matter of standard data integrity; (b) anonymized aggregate data; and (c) content involved in a pending investigation of a Terms violation.
6.3 Representations. You represent and warrant that:
- You own or have the necessary rights to your User Content.
- Your User Content does not infringe the rights of any third party, including intellectual-property and privacy rights.
- Your User Content does not violate these Terms or any applicable law.
7. Photos and admin moderation
Every photo submitted to the Service is reviewed by a NAMPS admin before becoming visible to other members. Photos that are explicit, deceptive (e.g., heavily edited or AI-generated), of someone other than the profile subject, older than five years (where this is determinable), or otherwise inappropriate will be rejected, and you will be notified by email with the reason.
Profile content (the “about” description, marriage preferences, etc.) must be honest, in your own words, and in alignment with the values of the community served by NAMPS. Profanity, discriminatory language, harassment of others, and disrespectful descriptions of yourself or others are not permitted.
NAMPS admins are bound by a confidentiality commitment and may not share the contents of profiles outside their official moderation role.
8. Mutual-consent contact exchange
The Service is built around the principle of mutual consent. Your contact phone number is shared with another member only after both of you have accepted a request to exchange contact details. NAMPS will never share your contact information unilaterally with a member who has not been mutually accepted.
Once contact details are exchanged, conversations move outside of the Service. Members are solely responsible for their own conduct in conversations and meetings that occur outside of the Service. NAMPS is not a party to those conversations and cannot moderate them.
9. Reporting misconduct
If you encounter a profile, photo, or message that violates these Terms, please report it by emailing namcs.community@gmail.com with as much detail as possible. NAMPS admins will review every report and take appropriate action — which may include warning the member, removing content, suspending the account, or, in cases involving safety, contacting law-enforcement authorities.
We do not tolerate retaliation against members who report misconduct in good faith.
10. Privacy
Our handling of your personal information is described in the Privacy Policy, which is incorporated into these Terms by reference. By using the Service you acknowledge that you have read and understood the Privacy Policy.
11. Intellectual property
The Service, including the NAMPS name, logo, design, interface, software, and all related intellectual property (excluding User Content), is owned by NAMPS or its licensors and is protected by copyright, trademark, and other laws. You may not use any NAMPS marks, logos, or branding without our prior written permission.
12. Suspension and termination
12.1 By you. You may close your account at any time by emailing namcs.community@gmail.com with the subject “Delete my NAMPS account.” We will permanently delete your profile and associated data within thirty (30) days, subject to the exceptions described in our Privacy Policy.
12.2 By NAMPS. We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe that you have violated these Terms, that your continued use poses a risk to other members or to the Service, or for any other reason at our sole discretion. We will provide you with a reason where reasonably possible and where doing so does not compromise the safety of others or the integrity of an investigation.
12.3 Effect of termination.Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, dispute resolution, and these Terms’ governance and miscellaneous provisions) will survive.
13. Disclaimers
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the maximum extent permitted by applicable law, NAMPS disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.
NAMPS does not warrant that:
- the Service will be uninterrupted, timely, secure, or error-free;
- the information on the Service will be accurate or reliable;
- the persons you meet through the Service are who they represent themselves to be — though our admin verification process aims to make this very likely, NAMPS is not a background-check service;
- any relationship initiated through the Service will result in marriage or any other particular outcome;
- errors or defects in the Service will be corrected.
You assume all risk arising from your use of the Service and from any interactions with other members, whether on or off the Service.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NAMPS, ITS VOLUNTEERS, ADMINS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — including but not limited to lost profits, lost data, loss of goodwill, or emotional distress — arising out of or related to your use of the Service, even if NAMPS has been advised of the possibility of such damages.
IN NO EVENT WILL NAMPS’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID NAMPS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY (CURRENTLY ZERO, AS THE SERVICE IS FREE), OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above may not apply to you in full.
15. Indemnification
You agree to indemnify, defend, and hold harmless NAMPS and its volunteers, admins, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.
16. DMCA / copyright takedown
If you believe that User Content on the Service infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA) by emailing namcs.community@gmail.com with the subject “DMCA notice.” The notice must include:
- your physical or electronic signature, or that of a person authorized to act on behalf of the copyright owner;
- identification of the copyrighted work claimed to have been infringed;
- identification of the material that is claimed to be infringing, sufficient for us to locate it;
- your contact information (address, phone, email);
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
- a statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.
We will respond to valid DMCA notices in accordance with the DMCA. Repeat infringers’ accounts will be terminated.
17. Third-party services and links
The Service may contain links or references to third-party websites, applications, or services that are not owned or controlled by NAMPS. We are not responsible for the content, policies, or practices of any third party. Your interactions with third parties are solely between you and the third party, and you should review their terms and privacy practices before using them.
18. Changes to the Service
NAMPS may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
19. Changes to these Terms
We may revise these Terms from time to time. When we make material changes, we will notify you by email and post the revised Terms on the Service with an updated “Effective date.” Your continued use of the Service after the new effective date constitutes acceptance of the revised Terms. If you do not agree, you may delete your account before the changes take effect.
20. Governing law
These Terms are governed by and construed in accordance with the laws of the United States and the State of Texas, without regard to its conflict-of-laws principles. The application of the United Nations Convention on Contracts for the International Sale of Goods is excluded.
21. Dispute resolution
21.1 Informal resolution first. Before initiating any formal dispute, you agree to first contact us at namcs.community@gmail.com and attempt in good faith to resolve the matter directly. Most disagreements can be resolved this way.
21.2 Venue. If informal resolution fails, you and NAMPS agree that any judicial proceeding to resolve a dispute will be brought exclusively in the federal or state courts located in Harris County, Texas, and you and NAMPS consent to the personal jurisdiction of those courts.
21.3 No class actions. To the maximum extent permitted by law, you and NAMPS agree that any dispute will be brought on an individual basis only, not as a plaintiff or class member in any purported class or representative action.
22. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
23. Entire agreement
These Terms (together with our Privacy Policy and any other documents incorporated by reference) constitute the entire agreement between you and NAMPS concerning the Service and supersede any prior or contemporaneous understandings or agreements, whether written or oral.
24. Assignment
You may not assign or transfer these Terms or any rights under them without our prior written consent. NAMPS may assign these Terms in connection with a merger, acquisition, or sale of substantially all of its assets without your consent. Any assignment in violation of this section is void.
25. Force majeure
NAMPS is not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, governmental action, labor disputes, internet or telecommunications failures, or pandemic-related disruption.
